Terms of Service
Effective Date: May 27, 2026
These Terms of Service apply to the Ell Vii’s Automations website, chatbot, contact forms, website prototypes, website builds, hosting support, SEO support, CRM demos, chatbot services, phone workflows, automation support, and related business services.
1. Services
Ell Vii’s Automations may provide website design, website updates, SEO support, lead capture tools, chatbot setup, CRM workflows, automation setup, phone workflow support, consulting, and related digital business services.
2. Prototype Launch Scope
The Prototype Launch is a professional starting point, not an unlimited design process or full custom website package. Unless otherwise stated in writing, the base prototype may include a one-page website direction, lead-flow planning, mobile-friendly layout, basic SEO foundation, call/booking/payment path planning, and one revision round.
Multiple pages, custom photos, advanced edits, CRM, chatbot setup, hosting, phone workflows, booking/payment setup, ongoing support, repeated redesigns, and additional revision rounds are quoted separately before work continues.
3. Client Responsibilities
Clients are responsible for providing accurate business details, timely approvals, required account access, brand direction, content, images, logos, and other project materials. Clients are responsible for reviewing and approving project details before launch.
4. Client-Provided Content and Ownership
Clients are solely responsible for ensuring that all content, materials, images, logos, videos, text, trademarks, business names, customer data, testimonials, files, downloads, and other assets provided to Ell Vii’s Automations are legally owned by the client or properly licensed for the client’s business use.
By providing content or materials, the client represents that they have the legal right, license, permission, authorization, or ownership needed for Ell Vii’s Automations to use, edit, display, upload, publish, host, or incorporate those materials into a website, CRM, chatbot, automation, marketing workflow, or related service.
Ell Vii’s Automations is not responsible for independently verifying ownership of client-provided content unless a separate written agreement specifically states otherwise. This includes photos from a prior website, stock images, logos, brand names, videos, graphics, written copy, customer lists, testimonials, third-party designs, code, documents, or media created by another designer, agency, contractor, photographer, platform, or content owner.
5. Copyright, Trademark, DMCA, and Infringement Claims
Clients agree not to submit, request, publish, or ask Ell Vii’s Automations to use content that infringes or may infringe another party’s copyright, trademark, trade dress, publicity rights, privacy rights, contractual rights, intellectual property rights, or other legal rights.
If Ell Vii’s Automations receives a copyright complaint, DMCA notice, trademark complaint, platform notice, hosting complaint, legal demand, cease-and-desist letter, or similar claim involving client-provided or client-approved content, Ell Vii’s Automations may remove, disable, suspend, replace, or restrict access to the affected content, page, website, automation, chatbot, workflow, or service.
The client is responsible for claims and costs arising from client-provided content, client-approved content, client instructions, or client misuse of a website, CRM, chatbot, phone workflow, or automation system. This may include takedown work, replacement work, rework, legal fees, damages, settlements, platform fees, investigation time, remediation costs, and business disruption to the fullest extent allowed by law.
6. DMCA Notice Process
If you believe content hosted, displayed, or linked through a website or service managed by Ell Vii’s Automations infringes your copyright, you may send a written notice identifying the allegedly infringing material, the copyrighted work, your contact information, and any other information required by applicable law.
Upon receiving a legally sufficient notice, Ell Vii’s Automations may remove or disable access to disputed material and may notify the affected client. Copyright notices may be sent to the.velasquez.law@gmail.com.
7. Sensitive Data, PII, HIPAA, and Regulated Information
Clients must not provide, upload, request collection of, or instruct Ell Vii’s Automations to process protected health information, medical records, patient files, diagnosis information, prescription information, insurance information, Social Security numbers, payment card data, passwords, student records, children’s data, or other regulated sensitive information unless a written agreement is in place confirming required safeguards.
Clients in health care, wellness, medical, pharmaceutical, counseling, therapy, insurance, supplement, housing, finance, or other regulated industries are responsible for ensuring that website content, claims, forms, workflows, data collection, advertising language, and customer communications comply with applicable laws, licensing rules, privacy rules, industry regulations, platform policies, and professional standards.
Ell Vii’s Automations does not provide medical, legal, regulatory, pharmaceutical, insurance, compliance, or HIPAA advice. Unless expressly agreed in writing, standard websites, contact forms, chatbots, analytics tools, email tools, CRM tools, automation platforms, AI tools, and third-party integrations are not intended to collect or process protected health information or other regulated sensitive information.
8. Calls, Text Messages, AI Voice, and Outreach Compliance
Clients are responsible for ensuring that any phone numbers, email addresses, lead lists, customer lists, call lists, SMS lists, or marketing contacts provided to Ell Vii’s Automations were collected lawfully and may be used for the requested communication purpose.
Clients are responsible for obtaining and maintaining required consent for calls, text messages, automated messages, prerecorded messages, AI-assisted messages, marketing emails, follow-up messages, appointment reminders, missed-call texts, or similar communications. Clients are also responsible for honoring opt-out requests, unsubscribe requests, do-not-call requests, STOP requests, carrier rules, platform rules, anti-spam rules, and applicable communication laws.
9. Testimonials, Reviews, Advertising Claims, and Results
Clients are responsible for ensuring that testimonials, reviews, before-and-after images, case studies, performance claims, health claims, income claims, savings claims, customer quotes, and advertising statements are truthful, accurate, authorized, and not misleading.
Ell Vii’s Automations does not guarantee search rankings, sales, leads, customer volume, revenue, approval by advertising platforms, or business outcomes. Examples, estimates, mockups, or projected results are for planning purposes only unless confirmed in a separate written agreement.
10. Website Accessibility
Ell Vii’s Automations may use reasonable accessibility practices such as readable layouts, mobile-friendly structure, alt text where provided, clear navigation, and basic usability considerations. Unless a separate written agreement includes formal accessibility auditing, remediation, legal review, or WCAG compliance services, Ell Vii’s Automations does not guarantee that a website, chatbot, CRM, form, third-party plugin, embedded tool, or hosted service will meet a specific accessibility standard or legal requirement.
11. Payment Card Data and PCI
Clients and visitors should not submit full credit card numbers, payment card data, bank account information, passwords, Social Security numbers, or other highly sensitive financial information through standard contact forms, chatbot messages, email, or general website tools.
If payment processing is needed, Ell Vii’s Automations may connect or link to third-party payment processors. Payment card handling, PCI compliance, chargebacks, processor fees, payment disputes, tax collection, and account approval are the responsibility of the client and/or the applicable payment processor unless a separate written agreement states otherwise.
12. Third-Party Tools
Some services may rely on third-party platforms such as hosting providers, domain registrars, analytics tools, CRMs, calendar tools, AI services, chatbot providers, phone providers, email services, or payment processors. Ell Vii’s Automations is not responsible for outages, policy changes, billing changes, limitations, or errors caused by third-party providers.
13. Electronic Acceptance and Signatures
By submitting a form, checking an agreement box, typing a name, drawing a signature, clicking an acceptance button, replying with written approval, or otherwise electronically confirming agreement, the client agrees that the electronic action may be treated as acceptance of the applicable terms, scope, project details, and related agreement.
Ell Vii’s Automations may keep records of electronic acceptance, including name, email address, phone number, timestamp, source page, technical data where available, user-agent information, submitted form details, and agreement version for project documentation, account administration, dispute resolution, legal compliance, and business recordkeeping.
14. Client Files and Project Records
Ell Vii’s Automations may create internal project folders, client records, website folders, signed agreement records, notes, screenshots, drafts, assets, and related documentation to manage client work. Clients are responsible for keeping their own copies of important materials, website assets, contracts, and business records.
15. Limitation of Liability
To the fullest extent permitted by law, Ell Vii’s Automations is not liable for indirect, incidental, lost profit, lost revenue, data loss, platform outage, third-party service issue, or consequential damages arising from use of the website or services.
16. Acceptable Use
You agree not to misuse the website, chatbot, forms, or services. This includes attempting to disrupt the site, submit harmful code, abuse the chatbot, impersonate others, submit unlawful content, or use services for unlawful purposes.
17. Updates to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date.
